Testing Potential Employees &The Law

If you're considering evaluations for potential employees, it is very important to remember that tests must be designed and administered within the guidelines of the EEOC.

  • For the testing vendor, this means that the tests are objective and developed and reviewed by "subject experts".

  • The company administering the tests is responsible for giving tests that represent the knowledge needed for the position.

    For instance, it is perfectly acceptable to give a C++ test to a potential C++ programmer; however, it would be a violation of EEOC guidelines to consider a poor score on a Unix test for a C++ programmer position if UNIX knowledge is not needed for the job.
